By using 310 Snow’s services, you agree to these Terms and Conditions. If you disagree with any part of these terms, please do not use our services.

1. Services Provided

310 Snow provides commercial snow removal, parking lot maintenance, landscaping, and related property maintenance services as described on our website and in service agreements. Specific service details, schedules, and costs are outlined in individual contracts.

2. Contract Types

Seasonal snow removal contracts cover the period from November 1 to April 30, or as otherwise specified in your agreement. Seasonal lawn care contracts cover the period from May 1 to October 30, or as otherwise specified in your agreement. Pricing is fixed for the contract period, and priority service is guaranteed for contract clients. These contracts automatically renew unless a 30-day notice is provided.

For per-visit services, clients are charged based on the actual service provided. Pricing may fluctuate based on current conditions, and service availability depends on our current workload. Payment for per-visit services is due within 15 days of the invoice date.

3. Service Triggers

Unless otherwise specified in your contract, the standard trigger depth for snow removal is 5cm (2 inches) of accumulation. Custom trigger depths are available upon request. We continuously monitor the weather and mobilize our teams proactively to address these conditions.

4. Client Responsibilities

You agree to provide accurate property information and ensure clear access to all areas requiring service. It is your responsibility to mark or identify obstacles, curbs, and sensitive areas, as well as to notify us of any site changes or concerns. You must also maintain adequate lighting for winter service and ensure that catch basins and drainage systems are functioning properly. Invoices must be paid within the specified terms.

5. Our Commitments

We commit to responding according to your contract specifications and using appropriate equipment for your property. We will document our service visits, maintain proper insurance coverage, and address any service concerns promptly. Our goal is to provide professional and courteous service at all times.

6. Liability and Insurance

We maintain comprehensive liability insurance and accept liability for damage caused directly by our negligence. However, we are not liable for damage to unmarked obstacles, existing pavement damage, or issues caused by pre-existing property conditions. Curbs, wheel stops, and sensitive areas must be clearly marked. Any claims must be reported to us within 7 days of the occurrence.

We are not liable for the inability to perform services due to extreme weather, equipment failure, or circumstances beyond our control. We are also not responsible for ice conditions resulting from property drainage issues, accumulation occurring during active business hours when service was not scheduled, or damage from freeze-thaw cycles between service visits. Our total liability is limited to the annual contract value or $25,000, whichever is less. We are not responsible for indirect damages, lost revenue, or consequential damages. Clients are responsible for obtaining their own slip-and-fall liability insurance.

7. Service Standards

Contract properties will be cleared within the specified timeframes after a snowfall, based on the trigger depths outlined in the contract. Sand and de-icing applications will be performed as contracted. We ensure professional equipment operation, proper snow placement and management, and the cleanup of tracked snow at entrances to provide safe and accessible driving and walking surfaces.

8. Cancellation Policy

Seasonal contracts require 30 days of written notice for cancellation. Early cancellation may result in per-visit billing for any services already rendered. Lawn care contracts require 15 days of notice.

9. Payment Terms

We reserve the right to terminate service for non-payment and may terminate contracts with 30 days of notice for cause. For seasonal contracts, payment schedules are outlined in the agreement. Per-visit services are due within 15 days of the invoice. Late payments are subject to a 2% monthly interest charge, and services may be suspended for accounts that are more than 30 days overdue.

10. Communications and SMS/Text Messaging

310 Snow uses automated systems, including text messaging (SMS) and voice calls, to communicate with clients regarding service updates, appointment reminders, billing, and account notifications.

When you opt-in to receive communications from 310 Snow, you consent to receive text messages and phone calls related to your property maintenance services, quotes, scheduling, and weather-related alerts.

You can cancel the SMS service at any time. Just text “STOP” to the [Phone Number]. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages periodically based on service scheduling and weather events. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

11. AI Voice Agents and Call Recording

To improve customer service and ensure accurate documentation of service requests, 310 Snow utilizes AI-powered voice agents (such as Retell AI) for inbound and outgoing calls.

By communicating with us via phone, you acknowledge and consent that your call may be answered or initiated by an automated AI voice assistant. Furthermore, you consent that these calls may be recorded and transcribed for quality assurance, training, and compliance purposes in accordance with our Privacy Policy. If you do not wish to interact with an AI agent or have your call recorded, please hang up and contact us via email at info@310snow.com.

12. Weather Dependency

While we monitor weather conditions diligently, we rely on public weather forecasts and observations. Unpredicted weather events or localized conditions may impact service timing.

13. Modifications

We reserve the right to modify these Terms and Conditions with notice to contract clients. Continued use of services after modifications constitutes acceptance.

14. Dispute Resolution

Disputes will first be addressed through good-faith negotiation. Unresolved disputes will be handled through arbitration in Edmonton, Alberta, under Alberta law.

15. Entire Agreement

These Terms, along with any signed service contracts, constitute the entire agreement between you and 310 Snow regarding the services provided.
