Agreement to Terms
By using 310 Snow’s services, you agree to these Terms and Conditions. If you disagree with any part of these terms, please do not use our services.
Services Provided
310 Snow provides commercial snow removal, parking lot maintenance, landscaping, and related property maintenance services as described on our website and in service agreements. Specific service details, schedules, and costs are outlined in individual contracts.
Service Contracts and Pricing
Seasonal Contracts:
- Seasonal snow removal contracts cover the period from November 1 to April 30 (or as specified)
- Pricing is fixed for the contract period
- Priority service is guaranteed for contract clients
- Contracts automatically renew unless 30 days notice is provided
Per-Visit Services:
- Charged based on actual service provided
- Pricing may fluctuate based on conditions
- Service availability depends on current workload
- Payment due within 15 days of invoice
Snow Removal Trigger Depths
Unless otherwise specified in your contract:
- Standard trigger depth is 5cm (2 inches) of accumulation
- Custom trigger depths available upon request
- We monitor weather and mobilize proactively
Client Responsibilities
You agree to:
- Provide accurate property information
- Ensure clear access to all areas requiring service
- Mark or identify obstacles, curbs, and sensitive areas
- Notify us of any site changes or concerns
- Maintain adequate lighting for winter service
- Ensure catch basins and drainage are functioning
- Pay invoices within specified terms
Our Responsibilities
We commit to:
- Respond according to contract specifications
- Use appropriate equipment for your property
- Document service visits
- Maintain proper insurance coverage
- Address any service concerns promptly
- Provide professional, courteous service
Property Damage
- We maintain comprehensive liability insurance
- We are liable for damage caused by our negligence
- We are not liable for damage to unmarked obstacles, existing pavement damage, or issues caused by pre-existing property conditions
- Curbs, wheel stops, and sensitive areas must be clearly marked
- Claims must be reported within 7 days of occurrence
Force Majeure and Service Limitations
We are not liable for:
- Inability to perform services due to extreme weather, equipment failure, or circumstances beyond our control
- Ice conditions resulting from property drainage issues
- Accumulation occurring during active business hours when service wasn’t scheduled
- Damage from freeze-thaw cycles between service visits
Liability Limitations
- Our liability is limited to the annual contract value or $25,000, whichever is less
- We are not responsible for indirect damages, lost revenue, or consequential damages
- Clients are responsible for obtaining their own slip-and-fall liability insurance
Service Standards
Snow Removal:
- Contract properties cleared within specified timeframes after snowfall
- Trigger depths as specified in contract
- Sand/de-icing application as contracted
Quality Standards:
- Professional equipment operation
- Proper snow placement and management
- Cleanup of tracked snow at entrances
- Safe, accessible driving and walking surfaces
Cancellation and Termination
Client Cancellation:
- Seasonal contracts require 30 days written notice
- Early cancellation may result in per-visit billing for services rendered
- Lawn care contracts require 15 days notice
Our Cancellation:
- We reserve the right to terminate service for non-payment
- We may terminate contracts with 30 days notice for cause
Payment Terms
- Seasonal contracts: Payment schedules outlined in contract
- Per-visit services: Due within 15 days of invoice
- Late payments subject to 2% monthly interest charge
- Services may be suspended for accounts 30+ days overdue
Weather Monitoring Disclaimer
While we monitor weather conditions diligently, we rely on public weather forecasts and observations. Unpredicted weather events or localized conditions may impact service timing.
Modifications to Terms
We reserve the right to modify these Terms and Conditions with notice to contract clients. Continued use of services after modifications constitutes acceptance.
Dispute Resolution
Disputes will first be addressed through good-faith negotiation. Unresolved disputes will be handled through arbitration in Edmonton, Alberta, under Alberta law.
Entire Agreement
These Terms, along with any signed service contracts, constitute the entire agreement between you and 310 Snow regarding services provided.
